These Terms and Conditions ("Terms") set out the rules and expectations that apply to your use of the Tmotions Pilates website (the "Website") and all related services, including in-studio classes, private sessions, semi-private/duet sessions, group equipment classes, student packages, memberships, bookings, purchases, and events (collectively, the "Services"). Our Privacy Policy, Student Policies, and Studio Policies are incorporated into and form part of these Terms.
The headings used throughout these Terms are provided for organizational convenience only and do not affect interpretation.
PLEASE READ THESE TERMS CAREFULLY. By accessing or using the Website, booking a session or class, or purchasing any Service, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, please refrain from using the Website or our Services.
1. ELIGIBILITY & ACCESS
Use of the Website and participation in Tmotions Pilates Services is open to individuals who are at least 16 years of age, or who have obtained verifiable consent from a parent or legal guardian who is of the age of majority in Ontario. By using our Services, you confirm that you meet this requirement and that all information you provide is accurate, current, and complete.
For clients purchasing student-rate packages or utilizing student discounts, Tmotions Pilates reserves the right to request valid, current proof of enrollment (such as a valid post-secondary student ID or institutional email verification) at the time of purchase or prior to the first session. Failure to provide valid proof may result in the account being charged the standard retail rate or suspension of the package without refund.
We grant you a limited, personal, non-exclusive, and revocable right to access and use the Website for personal, non-commercial purposes. This right does not permit you to reproduce, distribute, or commercially exploit any part of the Website or its content. Tmotions Pilates reserves the right to restrict or revoke access to the Website or our Services at any time, for any reason, at our sole discretion.
2. SERVICES, PURCHASES & PAYMENT
All services offered by Tmotions Pilates—including but not limited to Private Sessions, Semi-Private/Duet Sessions, Group Equipment (Reformer, Tower, Chair) Classes, Mat Classes, student introductory packages, workshops, and recurring memberships—must be paid in full at the time of booking, unless otherwise stated at the point of purchase. All prices are listed in Canadian dollars and are subject to applicable taxes, including HST.
Payments are processed securely through our third-party booking and payment platform. Tmotions Pilates does not store your payment card information. By completing a purchase, you authorize us and our payment processor to charge the applicable amount to your chosen payment method.
Tmotions Pilates reserves the right to modify, discontinue, or reprice any Service at any time without prior notice. All purchases are subject to our Studio Policies in effect at the time of purchase, including policies on cancellations, expiration, no-shows, holds, and refunds. We encourage you to review the most current version of our Studio Policies before making any purchase.
3. CANCELLATIONS, NO-SHOWS & REFUNDS
All cancellations must be submitted through our approved online booking platform or via email in accordance with the notice periods outlined in our Studio Policies. Because session availability is strictly limited:
Private and Semi-Private/Duet Sessions: Cancellations must be made at least twenty-four (24) hours before the scheduled appointment.
Group Equipment and Mat Classes: Cancellations must be made within the designated window specified in our Studio Policies.
Cancellations made outside the permitted window, as well as late cancellations and no-shows, will result in the automatic forfeiture of the session credit or the assessment of a late-cancellation fee, as described in our Studio Policies.
All purchases—including student class packs, promotional packages, workshops, and drop-in sessions—are final. Tmotions Pilates does not offer refunds except where required by applicable Canadian law. Credits, private session packages, and group class packs are strictly non-transferable between different clients and cannot be exchanged between different class types (e.g., a mat class credit cannot be applied to a private equipment session) unless explicitly authorized by Studio management. All packages are subject to strict expiration dates from the date of purchase, as outlined in our Studio Policies.
Tmotions Pilates reserves the right to cancel or reschedule a session or class at its discretion (e.g., due to instructor illness or severe weather). Where the Studio initiates a cancellation, affected participants will be notified immediately and their session credit will be reinstated in full.
4. STUDIO RULES & PARTICIPANT CONDUCT
To maintain a safe, clean, and focused environment for all participants and students, the following rules apply whenever you are on Tmotions Pilates premises or participating in any Service:
Apparatus Safety: Pilates equipment (including Reformers, Towers, Chairs, and Barrels) may only be adjusted, set up, or operated under the direct supervision and instruction of a Tmotions Pilates instructor. Unauthorized or improper use of equipment is strictly prohibited.
Mobile Devices: Mobile phones must be silenced and kept outside the studio area or stored in designated cubbies during sessions. Exceptions may be made for genuine emergencies only, with prior notice given to your instructor.
Media Capture: Photography, video recording, and live streaming within the studio or during class are strictly prohibited to protect the privacy of clients and staff, unless prior written consent has been granted by Studio management.
Punctuality: Please arrive on time. For safety reasons, late arrivals to group classes may not be admitted once the warm-up phase has concluded, and the session will be treated as a late cancellation. For private sessions, late arrivals will receive the remaining duration of their scheduled time slot only, billed at the full session rate.
Health Disclosures: You must disclose any injuries, physical restrictions, surgeries, changes in medical history, or pregnancy to your instructor before the start of every session. Hands-on tactile adjustments are offered for safety and alignment purposes, and will be conducted with your ongoing consent.
Footwear & Hygiene: Street shoes are not permitted inside the studio training areas. Please leave footwear at the entrance. Grip socks are highly recommended for all equipment sessions for hygiene and safety purposes, unless otherwise directed by your instructor.
Conduct: Treat all staff, instructors, and fellow participants with respect, dignity, and consideration.
Tmotions Pilates reserves the right to remove, suspend, or permanently ban any participant whose behaviour is deemed unsafe, disrespectful, disruptive, or in violation of these Terms or our Studio Policies, without a refund.
5. HEALTH REPRESENTATION & ASSUMPTION OF RISK
By participating in any Tmotions Pilates class, private session, or activity, you represent that you are in adequate physical condition to do so. You acknowledge that Pilates, bodywork, and related physical fitness activities involve strenuous physical exertion and carry inherent risks of physical injury, and you voluntarily choose to assume those risks. This assumption of risk is in addition to, and does not replace, the Participant Waiver & Release of Liability you are required to sign prior to your first session.
Nothing in these Terms or on the Website constitutes medical or professional health advice. You agree not to rely on any content, instruction, or modification provided by the Studio or its instructors for medical purposes, and you are advised to consult a qualified healthcare professional before beginning any new exercise program, particularly if you have any chronic conditions, injuries, or pre-existing health concerns.
6. DISCLAIMER OF WARRANTIES
The Website and its contents are provided on an "as is" and "as available" basis, without representations or warranties of any kind. Tmotions Pilates makes no guarantees regarding the accuracy, completeness, reliability, or continued availability of the Website or any information contained within it. To the fullest extent permitted by Ontario law, all warranties—express, implied, or statutory—are expressly disclaimed, including any warranties of fitness for a particular purpose or non-infringement.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Tmotions Pilates, its owners, directors, officers, employees, instructors, contractors, and agents shall not be liable to you or any third party for any indirect, incidental, special, consequential, or punitive damages of any kind arising from or related to your use of the Website, your participation in any Service, or any change to the Services.
Your use of our Services is entirely at your own risk. This limitation applies regardless of the legal theory under which a claim is brought, and even if the Studio has been advised of the possibility of such damages.
8. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Tmotions Pilates and its owners, directors, officers, employees, instructors, contractors, and agents from and against any claims, liabilities, losses, damages, costs, and legal fees (including solicitor-client fees) arising out of or in connection with: (a) your use of the Website or Services; (b) your violation of these Terms; (c) any misrepresentation you make to the Studio; or (d) your conduct on Studio premises. This obligation survives the termination of these Terms.
9. INTELLECTUAL PROPERTY
All content on the Website and in connection with Tmotions Pilates’s Services—including but not limited to text, images, logos, branding, graphics, instructional materials, and layout—is the exclusive property of Tmotions Pilates or its licensors and is protected by applicable Canadian copyright and trademark law.
You are not permitted to copy, reproduce, modify, display, distribute, publish, or exploit any part of the Website or its content for commercial purposes without our prior written consent. Nothing in these Terms grants you any license or ownership interest in the Studio's intellectual property, whether expressly or by implication.
You may share a hyperlink to the Website, provided that doing so does not misrepresent the Studio, its Services, or its brand in any way.
10. THIRD-PARTY WEBSITES & CONTENT
The Website may include links to external websites or references to third-party tools, schedules, and payment resources (such as our third-party booking software) for your convenience. These links do not constitute an endorsement of those third parties or their content. We have no control over and take no responsibility for the content, privacy practices, or terms of use of any linked third-party site.
Your decision to access any third-party website or resource is at your own discretion and risk. We encourage you to review the terms and privacy policies of any external platform before engaging with it.
11. ELECTRONIC COMMUNICATIONS
When you contact us via email, submit information through the Website, or engage with our online booking platform, you are communicating with us electronically. You consent to receive communications from Tmotions Pilates electronically, including by email, text messages for booking confirmations/reminders (where opted-in), and through the Website platform. You agree that such electronic communications satisfy any legal requirement that notices or agreements be delivered in writing, to the extent permitted by applicable law.
12. ACCOUNT MANAGEMENT & STUDIO'S RIGHTS
Tmotions Pilates reserves the right to refuse, modify, suspend, or terminate any account, booking, student discount tier, or purchase at its sole discretion—including where we have reason to believe that these Terms, the student validation criteria, or our Studio Policies have been violated. We are not liable for any loss or inconvenience arising from such a decision.
Where possible, we will attempt to notify you using the contact details provided at the time of booking. You are responsible for keeping your contact information current and accurate.
13. NO WAIVER & NON-ASSIGNMENT
A failure or delay by Tmotions Pilates to enforce any provision of these Terms shall not be construed as a waiver of our right to do so in the future. Any waiver must be made in writing and signed by an authorized representative of the Studio to be effective.
These Terms and the rights and obligations arising from them are personal to you and may not be assigned, transferred, sublicensed, or delegated to any other person without our prior written consent.
14. CHANGES TO THESE TERMS
Tmotions Pilates reserves the right to update, modify, or replace these Terms and our related Studio Policies at any time. Any changes will be posted on the Website and will take effect immediately upon publication. The "Last Updated" date at the top of this document will reflect the most recent revision.
Your continued use of the Website or Services following any change constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically to stay informed of any updates.
15. TERMINATION
These Terms remain in effect until terminated by either party. You may terminate your agreement with us at any time by discontinuing use of the Website and notifying us in writing.
Tmotions Pilates may terminate your access to the Website and Services at any time, without notice, if we determine at our sole discretion that you have breached these Terms. All obligations and liabilities incurred prior to termination will survive and remain enforceable.
16. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and applicable federal Canadian law, without reference to conflict of law principles.
In the event of a dispute arising from or in connection with these Terms or our Services, the parties agree to first attempt resolution through good-faith negotiation. Where negotiation is unsuccessful, the parties agree to submit the dispute to in-person mediation in Toronto, Ontario, conducted by a mutually agreed upon professional mediator. If mediation does not result in a resolution, the dispute shall be submitted to the exclusive jurisdiction of the courts of Ontario.
17. ENTIRE AGREEMENT & SEVERABILITY
These Terms, together with the Tmotions Pilates Privacy Policy, Participant Waiver & Release of Liability, and Studio Policies referenced herein, constitute the entire agreement between you and the Studio with respect to your use of the Website and Services. They supersede all prior understandings, representations, and communications, whether written or verbal.
If any individual provision of these Terms is found to be invalid, void, or unenforceable by a court of competent jurisdiction, that provision will be severed from the remainder of the Terms, which will continue in full force and effect.
