Tmotions Pilates ("we," "us," or "our") recognizes that the privacy of your personal information is important. This Privacy Policy describes how we collect, use, disclose, and protect personal information in connection with our services, our website, and our studio operations. We are committed to handling all personal information in accordance with applicable Canadian federal and Ontario provincial privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL).

By engaging with our services, visiting our website, or providing us with your personal information, you acknowledge that you have read and understood this Policy and consent to the practices described herein.

This Policy applies to all personal information collected, used, disclosed, or retained by Tmotions Pilates in any form, relating to clients, prospective clients, website visitors, and other individuals who interact with us. It applies to information gathered through our studio, our website, and any booking or payment platforms we use.

This Policy does not apply to aggregated or anonymized data that cannot be linked to a specific individual, or to general business contact information such as a person's name and professional contact details used in a business context.

We may revise this Policy from time to time. Any updates will be reflected on our website and will take effect upon posting. We encourage you to review this Policy periodically.

2. PERSONAL INFORMATION WE COLLECT

We collect personal information only to the extent reasonably necessary for the purposes outlined in this Policy. The types of personal information we may collect include:

Information You Provide Directly

•  Full name, date of birth, and contact details (phone number, email address, mailing address)

•  Health information you voluntarily share, including physical limitations, injuries, or medical conditions relevant to your participation in our classes

•  Emergency contact information

•  Account credentials for our booking platform

•  Communications you send to us by email, phone, or through our website

Information Collected Through Your Use of Our Services

•  Class attendance history and booking records

•  Membership and package details, including purchase history

•  Technical data collected automatically when you visit our website, such as your IP address, browser type, operating system, pages visited, and session duration

•  Cookie data and anonymous website traffic analytics (see Section 9 for more detail)

Payment Information

Your payment and billing information is processed and stored directly by our third-party payment and booking platform providers (see Section 7). Tmotions Pilates does not collect, store, or have access to your full payment card details.

3. HOW WE USE YOUR PERSONAL INFORMATION

We use personal information only for the purposes for which it was collected, or for purposes consistent with those purposes, unless we have obtained your consent for a new use or as otherwise permitted by law. These purposes include:

•  Fulfilling and managing your class bookings, memberships, packages, and purchases

•  Providing safe and appropriate instruction, including accommodating injuries or physical limitations you have disclosed

•  Responding to your questions, concerns, and customer service requests

•  Processing payments and managing billing cycles through our authorized service providers

•  Communicating important updates about your account, schedule changes, or studio operations

•  Sending marketing and promotional communications, where you have provided consent or where permitted by CASL (you may opt out at any time — see Section 5)

•  Improving the quality and delivery of our services and website experience

•  Meeting our legal obligations and protecting our legal rights

•  Responding to emergency medical situations involving you on studio premises

We will not use your personal information for any new or unrelated purpose without first identifying that purpose and obtaining your consent, or as otherwise permitted by applicable law.

4. CONSENT

By providing your personal information to us — whether at the time of registration, booking, or through use of our website — you consent to the collection, use, and disclosure of that information for the purposes set out in this Policy.

Consent may be express (provided explicitly in writing or verbally) or implied (where the purpose for collection is obvious and you voluntarily provide your information). Where we intend to use your personal information for marketing or promotional communications, we will seek your express consent or provide you with a clear opportunity to decline.

You may withdraw your consent to the collection, use, or disclosure of your personal information at any time by contacting us at the details provided in Section 10. Please note that withdrawing consent may limit our ability to provide certain services to you, and we will explain any such implications when you make your request.

Withdrawal of consent does not apply retroactively and does not affect the lawfulness of any use of your information prior to the withdrawal.

5. MARKETING COMMUNICATIONS & OPT-OUT

Where you have consented to receive promotional emails from Tmotions Pilates, you may withdraw that consent at any time by:

•  Clicking the unsubscribe link included in any of our marketing emails

•  Emailing us directly at hello@tmotion.ca with a request to be removed from our mailing list

Please allow up to 10 business days for your opt-out request to take effect. Opting out of marketing communications does not affect the delivery of transactional messages related to your bookings or account.

6. WHEN WE SHARE YOUR INFORMATION

Tmotions Pilates does not sell, rent, or license your personal information to any third party under any circumstances. We may share your personal information in the following limited situations:

Service Providers

We work with trusted third-party service providers to operate our business, including booking and payment platforms, website hosting, and email marketing tools. These providers are given access to only the information necessary to perform their specific functions and are contractually required to protect your information in accordance with applicable law and privacy standards consistent with this Policy.

Legal Requirements

We may disclose personal information where required or authorized by law, including in response to valid legal process such as a court order or regulatory request, or where we believe disclosure is necessary to investigate suspected unlawful activity, enforce our legal rights, prevent harm to any person, or cooperate with a law enforcement investigation.

Emergency Situations

In the event of a medical or safety emergency involving you on our premises, we may disclose relevant personal information — including health information you have provided — to emergency responders or your designated emergency contact.

Business Transfers

In the event that Tmotions Pilates undergoes a business transition such as a sale, merger, or acquisition, personal information may be transferred as part of that transaction. 7. THIRD-PARTY PLATFORMS & SERVICE PROVIDERS

When you book or purchase services from Tmotions Pilates, you may be required to create an account with one or more of our third-party booking or payment platforms. Your account credentials and payment details are managed and stored by these platforms — not by us. You are responsible for keeping your account credentials secure and for all activity conducted under your account.

We are not responsible for the privacy practices, security measures, or data handling of third-party platforms. We encourage you to review the privacy policies of the platforms we use. These currently include:

Please note that some of these providers may store your information on servers located outside of Canada, where it will be subject to the privacy laws of that jurisdiction. Your use of these platforms is at your own discretion and governed by their respective terms and policies.

8. HOW WE PROTECT YOUR INFORMATION

Tmotions Pilates implements reasonable and appropriate safeguards to protect personal information from loss, unauthorized access, use, disclosure, or modification. These measures include:

•  Restricting access to personal information to authorized personnel only

•  Securely disposing of personal information when it is no longer required

While we take the protection of your personal information seriously, no security system is infallible. We cannot guarantee the absolute security of information transmitted over the internet or stored on internet-connected servers. In the event of a privacy breach that poses a real risk of significant harm to you, we will notify you and the applicable regulatory authority as required by law.

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law or regulation. When personal information is no longer needed, it is securely destroyed or anonymized.

9. COOKIES & WEBSITE ANALYTICS

Our website uses cookies — small text files stored on your device — to collect anonymized data about how visitors navigate and interact with our site. This information is used to improve website performance and user experience. Cookie data on its own cannot be used to identify you personally.

You may disable or remove cookies at any time through your browser settings. Please note that doing so may affect the functionality of certain features on our website.

10. YOUR RIGHT TO ACCESS & CORRECT YOUR INFORMATION

You have the right to request access to the personal information Tmotion Pilates holds about you, and to request that any inaccurate or incomplete information be corrected. To make such a request, please contact our Privacy Officer in writing at the details provided in Section 12.

We will respond to all reasonable access requests within a reasonable timeframe. In some cases, we may be required or permitted by law to decline access, such as where disclosure would reveal information about another individual, is subject to solicitor-client privilege, or could compromise a legal investigation. Where access is denied, we will advise you of the reason.

We aim to keep your personal information accurate and up to date. We ask that you notify us of any changes to your contact or health information that may affect how we serve you.
